Distributive justice, judicial activism, and the institutional challenges of the judge in leveling social inequalities: reflections on the ruling “V. O., E. v. State of Buenos Aires Province”

In certain models of the democratic rule of law, the State is understood to be required to adopt measures aimed at guaranteeing essential conditions such as health, education, and employment, thereby enabling individuals to pursue their life projects. However, while primary responsibility for implementing these policies lies with the legislative and executive branches, the role of the judiciary in supervising and guaranteeing social rights remains a subject of debate. This article analyzes the ruling “V. O., E. v. State of Buenos Aires Province” by the Administrative Court of Appeals of La Plata, which ordered the payment of a minimum wage to a single mother in a situation of vulnerability. Based on this precedent, the article reflects on the scope of judicial intervention in the protection of social benefits, in order to assess how the judiciary may contribute to the enforcement of social rights without undermining the principle of separation of powers.
