Entre el significado original y la movilización social: el caso de la segunda enmienda a la Constitución de los Estados Unidos de América

Resumen

En el presente trabajo me propongo explorar el surgimiento del derecho a poseer y portar armas en el ordenamiento jurídico estadounidense. Teniendo en cuenta los orígenes de la segunda enmienda a su Constitución y las intenciones que motivaron su adopción, argumento que el hecho de que se lea en ella un derecho de esta naturaleza no obedece a una interpretación del texto constitucional fiel a su significado original, sino a décadas de movilización social que, en conjunto con actores de la política, lograron exitosamente la reinterpretación de su significado.
