A case study of the recovery process of the Alcoyana textile company in the light of progressive property theories

Abstract

This case study seeks to provide qualitative empirical evidence on how the practice of a factory recovery process is developed by its workers, with special emphasis on the legal aspects of the process. The objective will be to reconstruct in a particular case how the regulation and the actions of the different branches of government favored, or did not favor, the workers' interest in recovering a bankrupt company in order to preserve their sources of employment. Likewise, an evaluative analysis will be made regarding how these interventions balanced the interest of the workers with the rights of the remaining creditors of the bankrupt company, and with the preservation of the rule of law more broadly.
