When rights are not universal: the case of voting by foreigners

Abstract

This paper describes the restrictions that foreigners have to exercise the suffrage. In particular, with respect to the European and Latin American States and the Argentine provinces, the scope of the right to elect political office for those who do not have the nationality of the State in which they reside is detailed. Likewise, and from a more conceptual point of view, the case of the right to elect foreigners is inscribed within the problematic overlapping between citizens' rights and human rights, diagnosed by Hannah Arendt and Giorgio Agamben.
