The PPP Contract and its new attractiveness: dispute resolution mechanisms

Abstract

Law No. 27.328 on Public-Private Partnership Contracts has incorporated to our legal system a figure widely used at international level, which will allow the execution of large and important projects of common interest. Among the great novelties included in the law we find the possibility of choosing expert panels and arbitration as dispute resolution mechanisms. These mechanisms, novel in our law for several reasons, will present a challenge to the academic and practical community to achieve their correct implementation. We believe that their incorporation was a wise decision and we will see their fruits in the medium term.
