Abstract

The article aims to examine some central ideas in the thought of Professor Eugenio Raúl Zaffaroni on the subject of criminal punishment, and in relation to the role of the judge in this respect. The selected aspects of Zaffaroni's work -only a few of the author's vast and complex work- are critically examined from the perspective of republican political philosophy, that is, from a theoretical conception that emphasizes the ideals of self-government, community and social integration.
