Some Considerations on the Reform Processes of the Argentine Provincial Constitutions

Abstract

The purpose of this article is to carry out an analysis of the different provincial constitutions in relation to the exercise of the derived constituent power, that is, the cases in which the people as sovereign decide to reform the previously established constitution; and the participation that citizens, in their capacity as holders of this constituent power, in each of the stages of the constitutional reform procedure that can be carried out for this purpose. The different systems of constitutional reform that are present in our provincial public law will be analyzed, with the requirements imposed by each of the provinces in order to carry out a reform of this type, particularly in relation to whom can submit a project to reform the constitution, the majority that is required, the possibility of veto by the governors, among other relevant aspects.
